1. Overview

This website is operated by Iron & Ivory Studio. Throughout these Terms of Service, “Iron & Ivory Studio,” “we,” “us,” and “our” refer to the operator of this website and store.

These Terms of Service govern your access to and use of ironandivorystudio.com and any related information, features, products, services, and purchasing experiences we provide through the website (collectively, the “Services”).

By visiting the website, submitting information, or purchasing a product, you agree to these Terms of Service and to the policies incorporated into them by reference. If you do not agree, do not use the Services.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

2. Eligibility and Acceptable Use

By using the Services, you represent that you are at least the age of majority in your jurisdiction or that you have authorized any minor dependents under your supervision to use the Services.

You may use the Services only for lawful, personal, and legitimate commercial purposes. You may not use the Services to violate applicable law, infringe another person’s rights, introduce malicious code, interfere with the website’s operation, collect information without authorization, make fraudulent purchases, or engage in abusive or deceptive conduct.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

3. Product Information and Visual Representation

We make reasonable efforts to describe and display our artwork, materials, frames, dimensions, colors, finishes, and other product attributes accurately.

Colors and tonal values can vary because of screen settings, ambient lighting, production processes, material characteristics, and normal manufacturing tolerances. Product images and room presentations are intended to help communicate appearance and scale but may not reproduce every physical characteristic exactly.

Please review the product description, selected medium, dimensions, frame choice, assembly option, price, and delivery information before placing an order. Contact us before ordering if you need help selecting a product or understanding its specifications.

Nothing in this section limits any rights you may have if an item is defective, incorrect, damaged, or materially different from its product description.

4. Prices, Payment, and Taxes

Prices are displayed in United States dollars unless otherwise indicated. Prices, promotions, product availability, and product specifications may change without notice.

Applicable shipping charges and taxes are calculated or displayed during checkout. You agree to provide current, complete, and accurate billing, payment, and contact information.

Payments are processed through Shopify and its supported payment providers. We do not directly store complete payment-card details.

5. Orders and Acceptance

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of that offer but does not guarantee acceptance or fulfillment.

We may reject, limit, or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or product-information errors, inventory or production limitations, shipping restrictions, or violations of these Terms.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

We reserve the right to limit quantities purchased by one person, household, account, payment method, billing address, shipping address, or order.

6. Made-to-Order Production, Changes, and Cancellations

Iron & Ivory Studio products are made to order. Production may begin soon after an order is placed.

Cancellation, product-change, or address-change requests must be submitted to support@ironandivorystudio.com within 12 hours of purchase. A request is not effective until we confirm it in writing. Once production has begun, an order generally cannot be cancelled or changed.

Customers are responsible for reviewing product selections and providing a complete and accurate delivery address before submitting an order.

7. Shipping and Delivery

We currently ship only to eligible street addresses within the contiguous 48 United States and Washington, DC. We do not currently ship to Alaska, Hawaii, U.S. territories, P.O. boxes, or APO/FPO/DPO addresses.

Products are produced, packaged, and shipped through Gelato and its network of independent production and delivery partners. Production locations and carriers may vary according to the product, destination, material availability, and production capacity.

Processing and delivery estimates are not guaranteed delivery dates. Delays may occur because of production requirements, carrier disruptions, severe weather, high-volume periods, address problems, or circumstances outside our reasonable control.

8. Returns, Replacements, and Refunds

Because our products are made to order, we do not accept returns or exchanges for change of mind, buyer’s remorse, incorrect size selection, or other preference-based reasons, except where applicable law requires otherwise.

If an order arrives damaged, defective, incorrect, or materially different from its product description, contact support@ironandivorystudio.com within seven days of delivery and provide the order number and clear photographs of the item, issue, and original packaging.

Do not return an item unless we provide written return instructions.

9. Intellectual Property

The website and its content—including artwork, photographs, product images, videos, writing, designs, graphics, logos, trademarks, collection names, page layouts, and other creative material—are owned by or licensed to Iron & Ivory Studio and are protected by applicable intellectual-property laws.

Purchasing a physical product does not transfer copyright, reproduction rights, commercial-use rights, or any other intellectual-property rights in the underlying artwork.

You may not reproduce, distribute, modify, publish, sell, license, scrape, train systems on, create derivative works from, or commercially exploit our content without prior written permission, except as permitted by applicable law.

10. Reviews, Messages, and Feedback

If you submit a review, comment, suggestion, photograph, or other content to us, you represent that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display content that you intentionally submit for publication or promotional use. This license does not apply to private customer-service communications, order information, or material you have not authorized us to publish.

We may remove submitted content that is unlawful, misleading, abusive, infringing, or unrelated to the Services.

11. Third-Party Services and Links

The Services may rely on or link to third-party providers, including Shopify, payment processors, fulfillment providers, carriers, analytics providers, social-media platforms, and other services.

We do not control independent third-party websites or their content, availability, privacy practices, or terms. Your use of third-party services may be governed by separate agreements between you and those providers.

The inclusion of a third-party link does not necessarily imply endorsement.

12. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that information may be processed by Shopify and other service providers as described in that policy.

13. Errors and Availability

Occasionally, the website may contain typographical errors, inaccurate information, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We may correct errors, update information, or cancel affected orders when reasonably necessary. If a material correction affects an order after payment, we will notify you and provide an appropriate remedy, including a refund when applicable.

We do not guarantee that every product or Service will remain available.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, timely, or error-free.

Products are subject to the express descriptions and policies published on the website and to any warranties or consumer protections that cannot lawfully be excluded.

Nothing in these Terms excludes or restricts rights or remedies that cannot be waived under applicable law.

15. Limitation of Liability

To the fullest extent permitted by law, Iron & Ivory Studio and its owners, employees, agents, contractors, licensors, service providers, and suppliers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products.

Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.

These limitations do not apply to liability that cannot legally be limited, including rights provided by applicable consumer-protection law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Iron & Ivory Studio and its owners, employees, agents, contractors, licensors, service providers, and suppliers from third-party claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

17. Termination

You may stop using the Services at any time.

We may suspend or terminate access if you materially violate these Terms, misuse the Services, threaten the security or operation of the website, or engage in fraudulent or unlawful activity.

Rights and obligations that by their nature should survive termination—including payment obligations, intellectual-property protections, disclaimers, limitations of liability, and dispute provisions—will continue to apply.

18. Severability and Waiver

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of that provision or any other right.

19. Entire Agreement

These Terms and the policies expressly incorporated into them constitute the agreement between you and Iron & Ivory Studio concerning the Services and supersede prior communications concerning the same subject.

Headings are included for convenience and do not affect interpretation.

20. Governing Law

These Terms are governed by the applicable laws of the United States and the State of Alabama, without regard to conflict-of-law principles, except where the mandatory laws of your jurisdiction provide otherwise.

21. Changes to These Terms

We may update these Terms to reflect operational, legal, regulatory, or service changes. Revised Terms will be posted on this page with an updated revision date.

Changes apply prospectively from their effective date unless applicable law requires otherwise. Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms.
